Terms of service
Last updated
These terms apply when you use Nomior Memory: this site, the App, the REST API and the MCP server that assistants connect to. By creating an account or using the service, you agree to them. Nothing in these terms limits rights you have by law as a consumer.
The service
Nomior Memory provides personal dashboards, an in-App assistant and an inbox for notifications, and lets assistants you connect read them. Answers from the in-App assistant are generated by AI models and can be wrong.
Your account
You need a Google account to sign in and must be at least 18. Keep access to your account secure; you are responsible for what happens under it, including through API keys and assistants you connect.
Plans and billing
There are two plans: Free, at no cost, and Premium, at $29 a month or $249 a year (US dollars). See pricing. During early access, plan limits are switched off: every signed-in account can use every product feature, whatever its plan, and buying Premium does not unlock anything extra while early access lasts. When early access ends, these terms and the Plan & billing page in the App will say what each plan includes.
Premium is billed in advance through Stripe, monthly or yearly, and renews automatically for the same period until you cancel. Stripe’s checkout shows the amount before you pay. You can cancel any time from Plan & billing in the App; cancelling stops the next renewal, and your plan stays active until the end of the period you paid for. We will tell you before any price change applies to you, and you can cancel before it does.
Right to withdraw (EU and UK)
If you live in the EU or the UK, you can withdraw from a Premium purchase within 14 days of buying it, without giving a reason. To withdraw, send us a clear statement, for example by email to support@nomior.com. You may use this model form, but you don’t have to:
To Nomior, support@nomior.com: I hereby give notice that I withdraw from my contract for the Nomior Memory Premium plan. Ordered on: [date]. Name: [your name]. Email address on the account: [email]. Date: [date].
We refund your payment within 14 days of receiving your notice, using the same payment method you paid with.
Refunds
Apart from the withdrawal right above and any refund the law gives you, cancelling does not refund the rest of a period you have paid for.
API, MCP and assistants
- Keep API keys secret. You can revoke them, and disconnect any assistant, from the App.
- Requests are rate-limited. The current limits are shown on the connect page and may change as plans change.
- An assistant you connect can read, and propose dashboard changes for you to confirm, within what you approved during sign-in. You are responsible for how you and your assistant use the answers.
- The API and the MCP server come with no uptime or response-time guarantee. We may change or retire endpoints and tools.
Acceptable use
You agree not to:
- Scrape the site or App, or get around rate limits, access checks or plan limits.
- Interfere with the service, probe it for weaknesses without permission, or reverse-engineer it.
- Use it for anything unlawful.
Your content
We give you a personal, non-transferable licence to use the service under these terms. What you create, such as your dashboards and the notes and widgets on them, stays yours; you let us store and process it only to run the service for you.
No warranty
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE EXTENT THE LAW ALLOWS, WE MAKE NO WARRANTIES ABOUT ACCURACY, COMPLETENESS, AVAILABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
Limits on liability
TO THE EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO WHAT YOU PAID US IN THE TWELVE MONTHS BEFORE IT AROSE.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law, and nothing limits your statutory rights as a consumer.
Suspension and ending
You can stop using the service and ask us to delete your account at any time. We may suspend or close accounts that break these terms or put the service or other users at risk, and will tell you why unless the law prevents it.
Your local law
If you are a consumer in the EU or the UK, you keep the protection of the mandatory laws of the country where you live, and you can bring claims in the courts there.
Changes
We may update these terms. When a change matters, we update the date at the top and tell signed-in users before it takes effect. Continuing to use the service after that means you accept the new terms.
General
- These terms, with the privacy policy, are the whole agreement between you and us about the service.
- If a court finds part of these terms unenforceable, the rest still applies. If we don’t enforce a term straight away, we can still enforce it later.
- You may not transfer your account or these terms to someone else. We may transfer them to a company that takes over the service, and your rights under them stay the same.
- We are not responsible for delays or failures caused by events outside our reasonable control.
- Terms that by their nature should last beyond the end of your account, such as the limits on liability and this section, keep applying after it ends.
- Send notices about these terms to support@nomior.com.
